Congratulations to Ericka J. Thomas, who represented the Village of Roselle before the Illinois Supreme Court in Roselle Police Pension Fund v. Village of Roselle, ___ Ill.2d ____, 2009 WL 711335 (March 19, 2009). The Illinois Supreme Court affirmed the appellate court’s decision that the Roselle Police Pension Board was not authorized by provisions of the Illinois Pension Code to grant the widow of a disabled police officer annual 3% cost of living increases. In so ruling, the Illinois Supreme Court noted that the language of the pension statute did not expressly grant the 3% annual increases and that it is up to the legislature to remedy the situation, not the courts.
